Compensation for harness injury.

John Coulson and the CNCI team assisted a client in settling a public liability claim.

Whilst taking part on an adventure course, the client was fitted with a harness which was very tight and became painful. Despite informing the instructors of this, the client was assured that everything was normal. Upon finishing the course, the claimant attended hospital after noticing some degree of blood loss. The client had suffered three deep cuts to the genital area on the left side.

The client suffered from further pain, severe discomfort and has developed anxiety following the incident.

Liability was not admitted by the Defendant and settlement offers were not forthcoming. Court proceedings were therefore issued, following which the Defendant put forward a settlement offer. The client was advised that this offer was low but further representations secured an increased figure which was acceptable to the Claimant.
