Advising with empathy and experience

Settlement following compromised recovery.

The CNCI team have secured £8000 compensation a claimant whose recovery from a leg  fracture was compromised by substandard care.

The claimant developed compartment syndrome after the injury and had an IIizarov frame fitted, an external appliance that is designed to heal fractures.

During his recovery the Claimant was told that everything was healing well until a subsequent examination by a different doctor revealed that the fracture was not aligning properly. The doctor advised that the IIizarov frame had not been correctly set up.

After a correctional surgery the claimant proceeded to recover and eventually had his IIizarov frame removed in March of 2010, almost two years after the initial accident.

Helen Younger of the CNCI team said “This individual had a significant underlying injury. Sadly his long recovery period was complicated by his problems in the initial treatment. We are pleased to have reached this settlement and delighted that the Claimant has made such a good recovery"
