Settlement follows surgical error.

John Coulson a Partner within the CNCI team helped a Claimant negotiate a settlement following a claim for clinical negligence, despite the Defendant not accepting liability and initially rejecting all offers for settlement.

The Claimant attended hospital to undergo a wound debridement enclosure of a left pressure sore. Two drainage tubes were in situ following the operation and when trying to remove the tubes it became apparent that the tube had been stitched to the Claimant’s hip and a second operation took place to remove it.

The Claimant spent twice as long in hospital as anticipated. He also suffered from infections after the operation, which required antibiotic treatment.

Following the issuing of court proceedings, John was able to keep open negotiation discussions and a settlement offer was put forward by the Defendant and accepted by the Claimant.
